TOUCFS004/18: Notify a change of name on a Contract for Services permit

Form TOUCFS004/18 tells the Employment Permits Section that the contractor or the relevant person named on a Contract for Services Employment Permit has changed after a transfer of undertaking. If the Department is satisfied, it re-issues the permit in the new name.

Who uses TOUCFS004/18

Use this form when a foreign national provides a service to an Irish client under a valid Contract for Services Employment Permit, and the name of the contractor (the foreign employer) or the relevant person (the Irish client) changes because of a transfer of undertaking under S.I. No. 131 of 2003, the TUPE regulations.

The contractor named on the permit arranges the form, even when it is the relevant person whose name has changed. Three parties sign: the current contractor, the new contractor or new relevant person taking over the business or contract, and the permit holder.

Holders of other permit types use a different Transfer of Undertaking form. For an Intra-Company Transfer permit, use TOUICT004/18. A change of name that is not a transfer of undertaking falls outside this form.

How and where to send it

Fill in the form in block capitals. Circle whether the change is to the contractor or the relevant person. Give the old and new names, the new address, and the new contractor's registration number (for example, its CRO number) if it has one. The contractor also confirms the contract services agreement is still in force.

Attach a letter from the contractor's solicitor or accountant confirming the transfer comes within the TUPE regulations and giving the date of the transfer. Add the new contractor's Revenue registration evidence, if applicable: a P30 return or receipt from the last 3 months, evidence of P30 SEPA direct debits in the previous 3 months, or, for a new contractor, a letter from Revenue confirming employer registration. Include the original and the certified copy of the permit.

The form's printed address is out of date. It names the Department of Business, Enterprise and Innovation at Earlsfort Centre, Dublin 2. The department is now the Department of Enterprise, Tourism and Employment, and its Employment Permits Section is at Lansdowne House, Lansdowne Road, Dublin 4, D04 A3A8.

The Department's FAQs say the Transfer of Undertaking form is accessed through the Employment Permits Online portal. Before you post anything, email employmentpermits@enterprise.gov.ie to confirm whether to upload it or send it by post.

Fees

The Department doesn't list a fee for this notification. Its fees page covers new permit applications and renewals only.

A later renewal of the permit carries the normal Contract for Services renewal fee.

Deadlines

The form says the notification must be made immediately following the transfer of the business or contract, in line with section 8(8) of the Employment Permits Act 2006.

If you do not notify, the Department may refuse future renewals of the permit. The Department does not publish a processing time for these notifications.

Common mistakes

  • Leaving out one of the three signatures. The current contractor, the new contractor or relevant person, and the permit holder must all sign.
  • Having the relevant person fill in the form. The contractor named on the permit arranges it, whichever name has changed.
  • Sending it without the solicitor's or accountant's letter confirming the TUPE transfer and its date.
  • Keeping the original permit or certified copy. Both go in with the form so a new permit can be issued.
  • Posting it to the Earlsfort Centre address printed on the form. The Employment Permits Section is now at Lansdowne House, Dublin 4.
  • Waiting until renewal time to report the change. The form says to notify immediately after the transfer.

Frequently asked questions

What happens after I send the form?

If the Department is satisfied the change comes from a transfer of undertaking, and the contract service agreement, terms, conditions, description and location of the job stay the same, it issues a new permit with the new name.

The Irish client changed its name, not us. Who files?

Still the contractor named on the permit. The Department needs to know about a transfer in the relevant person because its name is on the permit too.

What if we don't tell the Department?

The form warns that failing to notify may lead to refusal of future renewals of the permit.
